These Terms & Conditions ("Terms") govern your access to and use of the TapTunes® website, products, software, services, memberships, Tap to Play™ technology, Instant Music Cards™, digital experiences, analytics, and related features (collectively, the "Services").

Please read these Terms carefully before using TapTunes.

1. Owner & Operator

TapTunes, Inc. ("TapTunes," "we," "our," or "us") owns and operates the TapTunes® platform, including the TapTunes website, products, services, software, memberships, Tap to Play™ technology, Instant Music Cards™, digital experiences, analytics, and related content.

By accessing or using the TapTunes platform, purchasing products or services, or otherwise using any TapTunes offering, you agree to be bound by these Terms & Conditions.

2. Eligibility

You must be at least eighteen (18) years of age, or have the permission of a parent or legal guardian, to use the TapTunes platform.

By using TapTunes, you represent that you have the legal authority to enter into these Terms.

3. Orders & Payments

By placing an order, you agree to provide accurate billing, shipping, and payment information.

Prices, promotions, specifications, availability, and product offerings may change without notice.

TapTunes reserves the right to refuse, limit, or cancel any order due to pricing errors, inventory limitations, suspected fraud, payment issues, or other operational reasons.

4. Production, Fulfillment & Shipping

Standard production time is typically 7–10 business days after final order approval; however, production times may vary depending on order quantity, production capacity, and other operational requirements.

Rush production (under 7 business days) may be available upon request for an additional 12% fee.

Rush service is not available for all orders and is subject to production capacity and order qualification.

Orders are shipped via USPS unless otherwise specified. Once an order has been transferred to the carrier, TapTunes is not responsible for shipping delays, loss, damage, delivery issues, or packages delivered to an incorrect address provided by the customer. Any shipping claims or delivery issues must be addressed directly with the carrier.

For international orders, please contact us directly. International orders must be processed manually and cannot be placed through the online portal.

5. Refunds, Returns & Exchanges

All TapTunes products are custom made to order. As a result, all sales are final. Once an order has been placed, refunds, cancellations, returns, or exchanges are not permitted, except in the event of a manufacturing defect or an order fulfillment error by TapTunes.

6. User Content

TapTunes does not claim ownership of music, artwork, lyrics, photographs, videos, metadata, images, logos, trademarks, or other content submitted by users.

By submitting content, you represent and warrant that you own or have obtained all rights, permissions, licenses, and authorizations necessary to use and distribute that content.

You remain solely responsible for all submitted content.

7. Artist, Label & Rights Holder Responsibilities

Artists, managers, labels, publishers, distributors, catalog owners, estates, and other rights holders are solely responsible for obtaining all copyrights, publishing rights, neighboring rights, trademark permissions, publicity rights, synchronization rights, mechanical licenses, and any other permissions required for submitted content.

TapTunes does not verify ownership or licensing of submitted materials.

8. TapTunes® Artists & Playlists

TapTunes® Artists

The TapTunes® Artists page showcases original artists and exclusive album releases available through TapTunes.

Albums featured on the TapTunes Artists page are intended to be exclusive releases available only through TapTunes. Unless otherwise stated by the rights holder, these featured releases are not available for purchase, download, licensing, or streaming through any other website, marketplace, retailer, digital music service, or streaming platform.

The TapTunes Artists page is intended to introduce fans to artists and their exclusive releases. It is not designed to function as a complete artist website, online store, streaming service, or electronic press kit (EPK).

TapTunes reserves the sole right to determine the content, appearance, layout, organization, features, and presentation of the TapTunes Artists page. TapTunes may approve, edit, modify, decline, suspend, or remove any artist profile, release, or related content at any time, with or without notice, in its sole discretion.

Placement on the TapTunes Artists page is a privilege, not a guarantee, and remains at the sole discretion of TapTunes.

TapTunes® Playlists

The TapTunes Playlists section features professionally curated Instant Music Cards created for home, business, and commercial listening environments, offering music collections designed to complement specific moods, settings, and experiences.

Unless otherwise identified, all music featured within the TapTunes Playlists section is created, produced, licensed, or otherwise authorized for use by TapTunes and is available exclusively through TapTunes Instant Music Cards.

Each TapTunes Playlist is delivered on a collectible Instant Music Card and includes the applicable listening rights associated with that product as described at the time of purchase.

TapTunes reserves the sole right to create, edit, modify, update, approve, suspend, or remove any playlist, collection, or related content at any time, with or without notice, in its sole discretion.

9. Artificial Intelligence (AI)

TapTunes respects the ownership of your creative work.

Music, artwork, lyrics, videos, photographs, metadata, personal information, and all other customer-submitted materials are not used to train generative artificial intelligence (AI), large language models (LLMs), or similar machine learning systems operated by TapTunes, Inc.

If AI-powered features are introduced in the future, they will be designed to improve the TapTunes customer experience.

Customer content will not be used for AI model training without the customer's explicit permission.

10. Platform Availability

TapTunes continually improves its products and services.

Features, pricing, analytics, digital experiences, memberships, and functionality may be modified, enhanced, suspended, or discontinued at any time.

Although we strive for reliable service, uninterrupted availability cannot be guaranteed.

11. Tap to Play™ Technology

TapTunes products are designed to operate using compatible NFC-enabled smartphones or by scanning the printed QR code.

Compatibility depends on device capabilities, browser support, operating system, internet connectivity, and third-party technologies.

TapTunes is not responsible for limitations outside its reasonable control.

12. Analytics

Analytics provided by TapTunes are intended for informational purposes only.

While we strive for accuracy, we do not guarantee that analytics, reports, demographic information, or usage statistics are complete, uninterrupted, or error-free.

13. Intellectual Property

TapTunes®, Tap to Play™, Instant Music Cards™, logos, trademarks, software, graphics, website content, source code, documentation, and related materials are owned by TapTunes, Inc. or its licensors and are protected by United States and international intellectual property laws.

No portion of the TapTunes platform may be copied, reproduced, distributed, modified, reverse engineered, or otherwise used without prior written permission from TapTunes, Inc.

14. Acceptable Use

You agree not to:

Upload unlawful or infringing content.
Misrepresent ownership of submitted materials.
Attempt unauthorized access to TapTunes systems.
Interfere with platform security or functionality.
Use bots, scraping tools, or automated systems without written permission.
Violate any applicable law while using TapTunes.

TapTunes may suspend or terminate accounts that violate these Terms.

15. Privacy

Your use of TapTunes is also governed by the TapTunes Privacy Policy, which explains how personal information is collected, used, stored, and protected.

16. Disclaimer of Warranties

The TapTunes platform and all related products and services are provided "as is" and "as available."

TapTunes disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability, to the fullest extent permitted by law.

17. Limitation of Liability

To the fullest extent permitted by law, TapTunes, Inc., its officers, directors, employees, affiliates, licensors, partners, and suppliers shall not be liable for indirect, incidental, consequential, punitive, special, or exemplary damages arising out of or relating to the use of the TapTunes platform or any products or services.

TapTunes' total liability for any claim shall not exceed the amount paid by the customer for the applicable product or service giving rise to the claim.

18. Indemnification

You agree to defend, indemnify, and hold harmless TapTunes, Inc., its officers, directors, employees, affiliates, licensors, partners, and agents from any claims, damages, losses, liabilities, costs, or expenses, including reasonable attorneys' fees, arising from your use of the TapTunes platform, your submitted content, or your violation of these Terms.

19. Force Majeure

TapTunes shall not be liable for delays or failures resulting from events beyond its reasonable control, including natural disasters, acts of God, labor disputes, internet outages, cyberattacks, carrier delays, governmental actions, pandemics, or supply chain disruptions.

20. Governing Law and Jurisdiction

TapTunes, Inc. is registered to conduct business in the States of Florida and Tennessee.

These Policies and any dispute, claim, or legal proceeding arising out of or relating to the TapTunes website, products, services, or Instant Music Cards shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.

The parties agree that the state and federal courts located in Seminole County, Florida, shall have exclusive jurisdiction and venue over any such dispute, claim, or legal proceeding.

21. Changes to These Terms

These Policies may be updated or modified at any time without prior notice. Continued use of the TapTunes® website, products, or services constitutes acceptance of the then-current version of these Policies.
